Enforcement of Gahanna’s Smoke-Free Indoor Air Chapter of Code 519 begins on February 21, 2006. Gahanna’s new Code prohibits smoking in public places and places of employment including offices, shops, restaurants and bars. The Smoke-Free Indoor Air Code was a citizen-driven initiative to ban smoking in public places and places of employment. It was designed to protect Gahanna workers, residents and visitors from the dangers of secondhand smoke.

Enforcement
The Franklin County Board of Health is contracted by the City of Gahanna for the provision of health services and will serve as the primary enforcement agency. The Franklin County Board of Health is supported by the Gahanna Department of Police and Office of the Mayor.

Accountability
Gahanna’s Smoke- Free Indoor Air Chapter of Code 519 defines the responsible party as the proprietor of the establishment in which a smoking violation occurs. (Proprietor means the owner, manager, operator, liquor permit holder or other in-charge person.)

Penalties
Upon receipt of the first report that a violation of the Smoke-Free Indoor Air regulations has occurred, the proprietor of a public place or place of employment will receive a warning letter. If another violation occurs and is reported, it is considered a minor misdemeanor. Violations of any provision of Gahanna’s Smoke-Free Indoor Air Chapter of Code is punishable by a maximum fine of $150 plus court costs.
